These terms are an agreement between you and Momenori LLC, a Delaware limited liability company ("Momenori," "we," "us"). They govern your use of the marketplace at momenori.com that connects customers with local photographers. By creating an account or using the service, you agree to them.
You must be at least 18 years old to create an account. You are responsible for keeping your password confidential and for activity that occurs under your account. Provide accurate information and keep it current — including a working email address and mobile phone number, which we use to reach you about bookings.
Momenori provides the platform on which customers and photographers find each other, agree terms, and pay. The photography services themselves are provided by independent photographers, not by Momenori. We are not a party to the agreement between a customer and a photographer, and we do not employ photographers or guarantee the quality, safety, or legality of any shoot.
You are an independent contractor. You are responsible for the accuracy of your profile and pricing, for showing up to bookings you accept, for delivering the work you agreed to, and for your own taxes, insurance, and equipment.
You are responsible for providing accurate booking details, for being present at the agreed time and place, and for paying the agreed amount.
Payments are processed by Stripe. Momenori retains a service fee, disclosed at the time of booking. Cancellation and refund terms are shown at booking and vary by photographer. Disputes between customers and photographers should first be raised with the other party; if that fails, contact momenorisupport@momenori.com and we will try to help, though we are not obliged to resolve the dispute.
Program name: Momenori Booking Alerts
Program description: Transactional text notifications to registered Momenori users about activity on their account — new booking requests, changes to a booking's status (accepted, declined, cancelled), and new messages from the other party to a booking. We do not send marketing or promotional texts through this program.
Message frequency: Varies with your activity on the platform. Most users receive fewer than 10 messages per month.
Cost: Momenori does not charge for these messages. Message and data rates may apply from your mobile carrier.
To opt out: Reply STOP to any message from us. You will receive one confirmation message and then no further messages. If you have previously opted in and replied STOP, you can resubscribe by replying START.

Carriers are not liable for delayed or undelivered messages.
You opt in to this program by entering your mobile number during registration, verifying it with the one-time passcode we send, and checking the consent box. The box is not pre-checked. Consent to receive text messages is not a condition of creating an account or of purchasing anything on Momenori — if you do not opt in, we will notify you by email instead.

Photographers retain copyright in the photographs they take. By uploading portfolio images to Momenori, a photographer grants us a non-exclusive licence to display those images on the platform and in materials promoting the platform. Rights to photographs delivered from a paid shoot are as agreed between the customer and the photographer.
You may not upload content that infringes someone else's rights, that is unlawful, or that is sexually explicit, harassing, or hateful.
Do not use Momenori to break the law, to take payments off-platform in order to avoid fees, to scrape or copy the platform, to interfere with its operation, or to impersonate anyone. We may suspend or close accounts that do.
Momenori is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, and our total liability to you for any claim relating to the service is limited to the greater of the fees you paid us in the twelve months before the claim, or $100. We are not liable for indirect or consequential losses.
Nothing in these terms limits liability that cannot be limited by law.
You may close your account at any time. We may suspend or close your account if you breach these terms or if we are required to by law.
We may update these terms. We will post the new version here and update the date above. If the changes are significant, we will notify you by email. Continuing to use Momenori after that means you accept the new terms.
These terms are governed by the laws of the State of Washington, and the courts of King County, Washington have exclusive jurisdiction over any dispute.
